What's legal
Wisconsin tribes began taking sports bets in 2021 under amended gaming compacts. The state has compacts with all 11 federally recognized tribes, and the Department of Administration's Division of Gaming oversees them. Sports betting is legal only through those compacts, not through any state license.
Mobile betting exists on a small scale. The Oneida Casino sportsbook app has worked anywhere on Oneida Nation land since March 2024, though new users still have to activate their accounts and deposit at a casino location. Ask the casino which events are offered and where the app works.
Wisconsin's constitution has barred the Legislature from authorizing gambling since a 1993 amendment, apart from listed exceptions such as the lottery and bingo. That is why every new step runs through tribal compacts.
Crypto and offshore sites
No state-licensed Wisconsin online sportsbook exists, so there is no licensed Wisconsin app to take crypto. Licensed US sportsbooks generally do not take crypto deposits.
Offshore crypto sportsbooks hold no Wisconsin license. Act 247 does not change that: it covers only wagers made through a server on tribal land under a compact the tribe entered before April 1, 1993.
What's changing
Assembly Bill 601 passed the Assembly on February 19, 2026 and the Senate 21 to 12 on March 17, 2026. Governor Tony Evers signed it on April 9, 2026 as 2025 Wisconsin Act 247. It adds a clause to the statutory definition of a bet in section 945.01. A mobile wager placed in Wisconsin is outside that definition if the server sits on tribal land and the wager follows a qualifying compact.
Betting under the act cannot start until each tribe signs an amended compact and the US Interior Department approves it. On August 5, 2026, two groups, the Brown County Taxpayers Association and Citizens Defending Liberty, filed suit in Waukesha County with the Wisconsin Institute for Law and Liberty as counsel. The suit argues the 1993 amendment bars the law. The governor's office is defending it.
Tax note
Wisconsin taxes gambling winnings as income. For casual gamblers it follows the federal session method: net gains from winning sessions count as Wisconsin income, and net losses from losing sessions are not deductible on the Wisconsin return.
Federal tax applies to winnings at your ordinary rate, and large payouts can bring a W-2G. Keep records of wins and losses. The Woyale tax guides show a worked example, and a tax professional can address Wisconsin.
Common questions
Can I bet on sports online in Wisconsin?
Only through tribal apps while you are on tribal land. Statewide mobile betting is not live, because Act 247 needs amended compacts and federal approval first.
When will Wisconsin mobile betting launch?
No launch date has been set. Each tribe needs an amended compact, the Interior Department must approve it, and the lawsuit against the law is pending.
Is a crypto sportsbook legal in Wisconsin?
No. Offshore crypto sportsbooks hold no Wisconsin license, and Act 247 covers only tribal servers under compacts.
