What's legal
A 2020 law, ESHB 2638, allowed sports wagering only through amended tribal gaming compacts. The first sportsbook opened at Snoqualmie Casino on September 9, 2021. The Gambling Commission's casino directory now shows 24 of the state's 28 tribal casinos offering sports wagering.
Mobile wagers are legal only while you are physically on the casino's premises, and each casino must geofence its app. Washington has no statewide mobile market, so you cannot bet from home. The Commission bars anyone under 18 from sports wagering, so check the casino's own age rule before you go. Each tribe sets its own menu and limits.
Since June 11, 2026, under SB 6137, tribal sportsbooks may take bets on Washington college teams. Props on named players at Washington schools, coaching decisions and officiating calls stay off the board, and minor league sports remain barred.
Crypto and offshore sites
Washington has no licensed online sportsbook, so there is no licensed place to deposit crypto from home. Betting online from home is illegal, and offshore crypto sportsbooks hold no Washington license.
Taking bets as a business is bookmaking, which the Commission treats as professional gambling, from a gross misdemeanor up to a class B felony. If a bookie refuses to pay, the Commission says you have no legal recourse.
On December 9, 2025, the Commission said that offering event-based contracts or taking part in prediction markets is not authorized in Washington.
What's changing
Attorney General Nick Brown sued Kalshi in King County Superior Court on March 27, 2026. In July a judge found Kalshi likely violates state gambling law, and in August the judge ordered it to block Washington users from sports, election and similar markets, with a full geofence due by September 2 and $120,000 daily fines for missing it. Kalshi says federal law gives the CFTC exclusive authority.
Tax note
Washington does not tax wages or winnings as income today. Its 7% capital gains tax covers sales of assets such as stocks and bonds, not betting winnings. A 9.9% tax on income above $1 million, signed March 30, 2026, starts January 1, 2028.
Federal tax applies to winnings at your ordinary rate, and a casino may issue a W-2G on large wins. Keep records of wins and losses. The Woyale tax guides explain the federal rules, and a tax professional can confirm what applies to you.
