What's legal
Utah allows no gambling of any kind. Article VI, section 27 of the state constitution bars the Legislature from authorizing any game of chance, lottery or gift enterprise, for any reason. There is no state lottery, no casino and no sportsbook, and changing that would take a constitutional amendment.
Utah's criminal code defines gambling as risking anything of value on a contest, game or scheme where chance helps decide the outcome. Because Utah licenses nothing, no Utah agency can certify a betting site as legal.
Crypto and offshore sites
No licensed sportsbook exists in Utah, so none takes crypto. Offshore crypto sportsbooks are not licensed in any US state. Under Utah Code section 76-9-1404, intentionally offering online gambling to a person in Utah is a third-degree felony. A 2026 law, HB 243, effective May 6, 2026, added proposition bets (bets on an individual action, statistic or occurrence) to the statutory definition of gambling.
What's changing
The open issue is prediction markets. On August 4, 2026 a federal court ruled for Utah and against Kalshi, which had argued that federal commodities law shields it from the state's gambling ban. Kalshi appealed to the Tenth Circuit, which denied its request to block enforcement during the appeal on September 8.
On October 20, 2026 Attorney General Derek Brown filed a state-court lawsuit against Kalshi and related companies. It asks the court to stop sports, election, politics, culture and mention contracts in Utah, to enforce that with geolocation, and to order the defendants to give up profits and pay restitution. Federal appeals courts have split on the underlying question, so the Supreme Court may decide it.
Tax note
Utah taxes individual income at a flat 4.45% for 2026 (Utah Code section 59-10-104). Federal tax applies to winnings at your ordinary rate however you earned them, and a tax professional can say how both apply to you. The Woyale tax guides cover the federal rules.
Common questions
Is any sports betting legal in Utah?
No. Utah's constitution bars the Legislature from authorizing any game of chance, lottery or gift enterprise, so there is no legal sports betting.
Is Kalshi legal in Utah?
The state says no. A federal court sided with Utah on August 4, 2026, and the attorney general sued Kalshi on October 20.
Can the Utah legislature legalize it?
No. The constitution removes that power, so the constitution itself would have to be amended.
