What's legal

Pennsylvania took its first legal sports bets in 2018 at casinos and added online betting in May 2019. The Pennsylvania Gaming Control Board licenses and regulates operators under 4 Pa.C.S. Chapter 13C. You must be 21 or older, and online bets require you to be physically in Pennsylvania.

The Board's list of licensed online sports wagering operators currently names 11: Bet365, BetMGM, BetParx, BetRivers, Caesars Sportsbook, DraftKings, PlaySugarHouse, theScore Bet, FanDuel, Fanatics and Mohegan PA. Check an app against that list before you deposit. The Board also runs a self-exclusion program for anyone who wants to be blocked from licensed gambling.

Crypto and offshore sites

Licensed US sportsbooks generally do not take crypto deposits, and Pennsylvania's licensed operators are no exception. A crypto sportsbook that is not on the Board's list is operating without a Pennsylvania license, whatever its marketing says.

The Board also disciplines licensed books. On March 25, 2026 it fined BetMGM $100,000 after finding weak know-your-customer controls on its BetMGM and Borgata platforms. Four fraud rings had opened accounts with other people's identities and funded them with stolen or fraudulently obtained payment devices.

What's changing

Pennsylvania sits in the Third Circuit. On April 6, 2026 that court ruled 2 to 1 in KalshiEX v. Flaherty, a New Jersey case, that federal commodities law likely blocks New Jersey from applying its gambling laws to Kalshi's sports contracts. The ruling was at the preliminary injunction stage. New Jersey filed a petition asking the US Supreme Court to review it on September 2, 2026, and the response is due November 9.

Tax note

Pennsylvania taxes gambling winnings under its personal income tax at a flat 3.07 percent. The state treats gambling and lottery winnings as their own income class, and a loss in another class cannot offset them.

Federal tax applies at your ordinary rate on top of that. Keep detailed records and ask a tax professional how both apply to you. The Woyale tax guides cover the federal side with a worked example.

The Third Circuit, which covers Pennsylvania, ruled in April 2026 that federal law likely blocks state gambling laws from applying to Kalshi's sports contracts. New Jersey has asked the US Supreme Court to review that ruling.
