What's legal
Oregon runs sports betting as a state lottery product under ORS chapter 461. The Lottery launched its Scoreboard app in October 2019 and replaced it with DraftKings on January 18, 2022. DraftKings is the only statewide online sportsbook, so there is no competition between licensed apps.
You must be 21 or older to bet through DraftKings, according to the Lottery's help page. The Lottery's 18-and-over rule covers Scratch-its and jackpot games, not sports betting.
Tribal casinos offer in-person sports betting on their own premises, and Spirit Mountain Casino in Grand Ronde has a sportsbook. ORS 461.543 sends sports betting revenue to a dedicated Sports Lottery Account. For the Lottery product, the Lottery sets the rules and handles disputes as a state agency, with no separate regulator.
Crypto and offshore sites
Licensed betting in Oregon runs through the Lottery's DraftKings product. Offshore crypto sportsbooks are not licensed by Oregon, and the Lottery has no authority over them. If one freezes your balance, you have no Oregon regulator to complain to. Because DraftKings runs the product for the Lottery, any deposit rules come from the app's terms, so read them before you fund an account.
What's changing
The legal fight over prediction-market sports contracts is moving through federal courts. On August 28, 2026 the Ninth Circuit, which covers Oregon, ruled against Kalshi in a Nevada case and treated its sports contracts as bets, not swaps under federal law. Nevada can enforce its gaming laws. The Third Circuit went the other way in a New Jersey case, which makes Supreme Court review likely.
Tax note
Oregon taxes income at graduated rates from 4.75% to 9.9%, and gambling winnings count as income. Federal tax applies on top, and a sportsbook may issue a W-2G on large wins. Keep a log. The Woyale tax guides cover the federal rules, and a tax professional can speak to your Oregon return.
