What's legal
New Hampshire legalized sports betting with HB 480 in 2019, now codified as RSA 287-I, and launched on December 30, 2019. The state Lottery Commission runs the program rather than a casino regulator. An authorized bettor must be 18 or older and physically in New Hampshire when the wager is placed. Wagers on New Hampshire college teams, on any college event played in the state, and on any high school event are prohibited.
You can bet through the DraftKings app, at a New Hampshire Sportsbook venue, or at a Sports 603 retailer, according to the Lottery. DraftKings is the only licensed online operator. It has held an exclusive deal since launch, and in February 2026 the company announced the Lottery had extended it. Because the state runs a single-operator model, there is no competing app to compare, and the Lottery earns a share of the revenue under the contract.
Crypto and offshore sites
DraftKings in New Hampshire is funded in dollars, and we found no New Hampshire rule that allows crypto deposits. If you hold crypto, you would normally sell it for dollars first, which can be a taxable event.
Only the Lottery-contracted operator is licensed to take online bets. Every other online sportsbook that accepts New Hampshire wagers is unlicensed in the state. Offshore crypto sportsbooks are not licensed in any US state, so using one means no state regulator stands behind your balance or your payout, and a withheld withdrawal has nowhere official to go.
What's changing
The Lottery extended DraftKings' contract in 2026, so DraftKings remains the sole online operator. A 2025 bill, HB 83, proposed raising the minimum betting age, but the statute on the legislature's site still reads 18. Adding operators would cut into the state's revenue share under the current deal, so a second online book is unlikely soon. We found no New Hampshire enforcement action against Kalshi or other prediction markets.
Tax on winnings
New Hampshire has no state income tax on wages or on gambling winnings, so only federal tax applies. You still report gambling income on your federal return, so keep a record of wins and losses and ask a tax professional about your own situation.
