Is crypto sports betting legal in Nevada?

A packed stadium under floodlights
Short answer

Sports betting has been legal in Nevada since 1949, and licensed apps work statewide, but you must verify your ID in person to open an account. You must be 21. Licensed books fund accounts in dollars. Nevada regulators and a federal appeals court have blocked Kalshi's sports contracts, and offshore crypto books hold no Nevada license.

What's legal

Nevada is the original legal sports betting state. Licensed sports books have operated there since 1949, long before the 2018 Supreme Court decision that opened the rest of the country. The minimum age is 21, and the Nevada Gaming Control Board and Gaming Commission license and police the market under NRS chapters 463 and 464.

Mobile betting is legal, with one catch. Under Regulation 22.140 and Regulation 5.225, a patron must present government-issued photo ID to a licensed book or casino employee in person to open a wagering account. The version of Regulation 22 posted in January 2026 still contains that rule. Apps are tied to Nevada casino licenses, which is why national brands without a Nevada casino partner, such as DraftKings and FanDuel, do not run sports betting there. You must be physically inside Nevada to place a mobile bet.

Crypto and offshore sites

Licensed Nevada sportsbooks fund accounts with cards, bank transfers and cash at the casino, and we found no Nevada rule that allows crypto deposits. If you hold crypto, you would sell it for dollars first, which can be a taxable event.

The in-person sign-up rule pushes some people toward offshore sites. Those hold no Nevada license and are not licensed in any other US state either, so no regulator stands behind your balance or your payout. Nevada law makes it a licensing matter: anyone taking bets in the state must be licensed by the Board.

What's changing

Nevada is the most active state against sports event contracts. The Board sent Kalshi a cease-and-desist letter on March 4, 2025 and Crypto.com one on May 20, 2025, and it filed state-court enforcement actions against Polymarket, Coinbase and Kalshi in early 2026. A state court enjoined Kalshi on April 3, 2026, and in June the Board asked the court to hold Kalshi in contempt for not geofencing Nevada as ordered on May 18. On August 28, 2026, the Ninth Circuit sided with Nevada: it treated Kalshi's sports contracts as wagers rather than swaps under federal law. That leaves the state free to apply its gaming law. The Crypto.com and Robinhood appeals were decided the same day, and a Supreme Court petition looks likely.

Tax on winnings

Nevada has no state personal income tax, so winnings are taxed only federally. Casinos may issue federal tax forms on large wins, and you still report all gambling income on your federal return.

Common questions

Can you sign up for a Nevada sports betting app remotely?

No. Nevada rules require you to show government-issued ID in person to a licensed book or casino employee before the account is opened.

Is crypto sports betting legal in Nevada?

Licensed Nevada books fund accounts in dollars through cards, bank transfers and casino cash. Offshore crypto sportsbooks hold no Nevada license.

Can Nevada stop Kalshi from offering sports contracts?

Yes, for now. A Nevada court enjoined Kalshi in April 2026, and on August 28, 2026 the Ninth Circuit held that Nevada may enforce its gambling law against it. Kalshi has said it will keep fighting.
