What's legal
Kentucky legalized sports wagering with House Bill 551 in 2023. The Kentucky Horse Racing and Gaming Corporation (KHRG, still often called the KHRC) says retail sportsbooks opened on September 7, 2023, and mobile apps on September 28, 2023. Under KRS 230.805, licensees must keep anyone under 21 away from sports wagering, in a licensed facility or online.
Only licensed horse racing associations can hold an operator license. They contract with outside service providers, which run the apps. KHRG's public partnership list currently shows eight providers with a mobile partnership: Bet365, BetMGM, Caesars, Circa Sports, DraftKings, FanDuel, Fanatics and theScore Bet. Kambi runs retail-only books at several tracks. You must be physically in Kentucky when you place an online bet.
Crypto and offshore sites
The licensed Kentucky apps fund accounts with cards, bank transfers and similar methods. The big licensed brands do not take crypto. If you hold crypto, you would normally sell it for dollars first, which can create a taxable event of its own.
Offshore crypto sportsbooks hold no Kentucky license. They are not licensed in any US state, so using one means no state regulator stands behind your balance or your payout. The attorney general's June 2026 complaints also cite Kentucky's Loss Recovery Act, so the state is treating unlicensed betting as a consumer-protection problem.
What's changing
On June 17, 2026, Attorney General Russell Coleman filed three separate suits in Franklin Circuit Court. The defendants are Kalshi (with affiliates including Coinbase), Polymarket and the sweepstakes casino operator VGW. The state says none of them hold a Kentucky gaming license. The complaints against Kalshi and Polymarket target contracts that work like moneyline, spread and player-prop bets.
About a week later, on June 23, the federal Commodity Futures Trading Commission sued Kentucky, naming the governor, the attorney general and KHRG, and asking a federal court to block enforcement against CFTC-registered exchanges. Kalshi and Polymarket have also moved the state cases to federal court. All of this is still being litigated, so the legal status of sports contracts in Kentucky is open.
Tax on winnings
Kentucky taxes gambling winnings as ordinary income at a flat state income tax rate of 3.5 percent for 2026, down from 4 percent in 2025, on top of federal tax. Keep records of wins and losses, and ask a tax professional about your own return.
Common questions
Is crypto sports betting legal in Kentucky?
Betting with a state-licensed sportsbook is legal, but those books generally do not take crypto. Offshore crypto sportsbooks are unlicensed in Kentucky.
How old do you have to be to bet in Kentucky?
You must be 21 or older. KRS 230.805 requires licensees to block anyone under 21, in person and online.
Is Kalshi legal in Kentucky?
It is being fought in court. The attorney general sued Kalshi in June 2026, and the CFTC then sued Kentucky, so no court has given a final answer yet.
