What's legal
Hawaii has no casinos, no state lottery and no licensed sportsbook. The Hawaii Penal Code's gambling offenses, in sections 712-1220 to 712-1231 of the Hawaii Revised Statutes, make betting on a game a crime. Because nothing is licensed, there is no gaming regulator to check a site against. Social gambling among friends is treated more leniently in the statute, but it is not a betting market.
Crypto and offshore sites
No licensed book exists to take a crypto deposit. Offshore crypto sportsbooks are not licensed in Hawaii or any other state, so no US regulator stands behind your funds and no Hawaii agency handles complaints about them.
Betting with one can fall under Hawaii's gambling law. No Hawaii official has announced enforcement aimed at crypto or offshore sportsbooks. Ask a Hawaii lawyer if you need advice on your own case.
What's changing
In 2025, HB 1308 would have licensed online sportsbooks. It passed the House and, on April 8, 2025, the Senate by 15 to 10, but the chambers could not agree in conference and the bill was carried into 2026. The conferees were discharged in March and April 2026, and the bill went no further.
The 2026 companions, SB 3303 and HB 2570, proposed at least six licenses and a 15% tax. SB 3303 was referred to committees on February 2, 2026 and never heard. HB 2570 cleared one House committee 4 to 3 on February 11 and was referred on to two more, with no further action on the record.
A separate bill, HB 2198, would classify prediction-market contracts on sports and other events as gambling. It passed the House unanimously on March 10, 2026 and was referred to Senate committees on March 12, with no later action.
Tax
Hawaii taxes gambling winnings as income. The Department of Taxation's top rate is 11%, and federal tax applies on top.

No. Hawaii has no casinos, lottery or licensed sportsbooks. Bills to allow online sportsbooks died in 2025 and did not advance in 2026.
Could Hawaii legalize online sports betting soon?
Supporters keep filing bills, but the legislature has never sent one to the governor. The next chance is the 2027 session.

No licensed one exists. Offshore crypto sportsbooks have no Hawaii license, and betting with them may break state gambling law.
