What's legal

Hard Rock Bet is the only legal sportsbook in Florida. The Florida Gaming Control Commission said so in February 2025, calling it the only online sportsbook operating lawfully in the state. The Seminole Tribe runs it under a 30-year compact signed in April 2021 and ratified in section 285.710 of the Florida Statutes. Bets placed anywhere in Florida count as placed on tribal servers, which is how the app works statewide. It launched in November 2023.

A federal appeals court upheld the compact in June 2023 in West Flagler Associates v. Haaland. The U.S. Supreme Court denied review on June 17, 2024. You must be 21. DraftKings, FanDuel and every other app are unlicensed in Florida.

Crypto and offshore sites

Offshore crypto sportsbooks are not licensed in Florida or any other state. Under section 849.14 of the Florida Statutes, taking bets on sports outside the compact is a felony, and the commission has said so in writing.

On February 3, 2025, the commission sent cease-and-desist letters to three overseas operators, BetUS, Bovada and MyBookie, demanding they stop taking Florida bets. In September 2023 it sent similar letters to the pick'em fantasy operators PrizePicks, Underdog and Betr. On August 19, 2026, Attorney General James Uthmeier sued the sweepstakes casinos Stake and VGW, the maker of Chumba Casino, and the payment processors that served them. The suits say players could cash out their sweepstakes coins for crypto, gift cards or cash.

The commission's FAQ page explains how to tell whether a sports betting app is legal. In Florida the answer is short: if it is not Hard Rock Bet, it is not licensed. An unlicensed site gives you no Florida regulator to complain to if a withdrawal stalls.

What's changing

The compact gives the tribe exclusive rights to sports betting, so a second sportsbook would need a new agreement with the tribe. The state's recent enforcement has centered on offshore books and sweepstakes casinos, and the commission has described illegal online gambling and unlawful sports betting as enforcement priorities.

Tax

Florida has no state income tax, so gambling winnings face federal tax only.
