What's legal
Delaware was one of the first states to take single-game bets after the 2018 Supreme Court ruling, and it did so at its three racetrack casinos: Delaware Park, Bally's Dover and Harrington. The Delaware Lottery runs the program and chooses its own technology partner rather than licensing many brands.
The Lottery picked Rush Street Interactive, the company behind BetRivers, as its online provider. Online sports betting soft-launched on December 27, 2023, under an initial five-year term. The Lottery's iGaming page now points players to the three casinos' online sites, all powered by BetRivers. You must be 21 or older and in Delaware to bet, online or in person. The Lottery publishes its Sports Lottery regulations on the state's regulations website and states that the program is not associated with or authorized by any professional or collegiate sports organization.
Crypto and offshore sites
Offshore crypto sportsbooks are not licensed in Delaware or any other US state. Under Delaware's lottery model, the only legal sports bets are those the Delaware Lottery authorizes, so a site outside the casinos' BetRivers-powered platforms is unlicensed.
Before you deposit anywhere, check the Lottery's iGaming and Sports Lottery pages for the authorized sites. There is only one online operator, so any other app claiming Delaware customers is unlicensed. An unlicensed site has no duty to follow Delaware consumer rules, and you would have no regulator to complain to if a withdrawal stalled.
What's changing
Delaware's single-operator model means the national brands cannot enter without a new law or a new contract. A 2024 bill, HB 365, would have let each casino partner with up to two online sportsbooks. It died when the legislative session ended in June 2024, and BetRivers stayed the sole operator.
Tax
Delaware taxes income at graduated rates. The Division of Revenue's tax year 2025 table tops out at 6.6% on taxable income of $60,000 and over, so gambling winnings count as taxable income on top of federal tax.
Common questions
Is online sports betting legal in Delaware?
Yes, through one state-authorized operator. BetRivers, run for the Delaware Lottery, has been the only online sportsbook since December 2023, and you must be 21.
Can you use DraftKings or FanDuel in Delaware?
No. Neither is licensed for online betting in Delaware, because the Lottery works with a single online operator.
Are crypto sportsbooks legal in Delaware?
Offshore crypto sportsbooks hold no Delaware license. Only sports betting authorized by the Delaware Lottery is legal in the state.
